1. Agreement to Terms

Welcome to Kizod Blog API ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, API services, and related applications (collectively, the "Service"). 6. User Generated Content

However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content in connection with operating and providing the Service.

Content Guidelines

You represent and warrant that:

• You own or have the necessary licenses to your User Content
• Your User Content does not violate any third-party rights
• Your User Content is accurate and not misleading
• Your User Content does not violate these Terms or any applicable laws

Content Monitoring

We reserve the right, but have no obligation, to:

• Monitor User Content for violations of these Terms
• Remove or refuse to post any User Content for any reason
• Take appropriate legal action against users who violate these Terms

We do not endorse any User Content and are not responsible for its accuracy or reliability.

7. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for your personal or business purposes
• Use our API to integrate blogging functionality into your applications
• View and interact with publicly available content

This license does not include any right to:

• Resell or commercially exploit the Service

• Use data mining or similar data gathering methods
• Frame or mirror any part of the Service

8. API Usage Guidelines

• Excessive requests may result in temporary or permanent API bans

• You must use valid JWT tokens for authenticated requests

API Changes

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation a breach of these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated content
• You will not be entitled to any refunds or compensation
• Sections that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or deleting your account through the Service. Upon termination, your User Content may be permanently deleted.

11. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Service.

We do not guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Service at any time or for any reason without notice to you.

You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Service during any downtime or discontinuance of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

13. Dispute Resolution

Informal Resolution

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting us at kizodtechnology@gmail.com. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or we may bring a formal proceeding.

Binding Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration conducted in the Netherlands, in accordance with the rules of the Netherlands Arbitration Institute. The arbitration shall be conducted in English, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized access to the Service.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KIZOD BLOG API, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS SHALL BE LIMITED TO THE AMOUNT YOU PAID US, IF ANY, FOR USING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

16. Indemnification

You agree to defend, indemnify, and hold harmless Kizod Blog API and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of the Service.

17. User Data

We will maintain certain data that you transmit to the Service for the purpose of managing the performance of the Service, as well as data relating to your use of the Service. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Service.

You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

18. Electronic Communications

Visiting the Service, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications from us, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Service, satisfy any legal requirement that such communication be in writing.

You agree to keep your email address current and to promptly notify us of any changes.

These Terms constitute the entire agreement between you and us regarding the use of the Service. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.

Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Relationship of Parties

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and us. You agree that these Terms will not be construed against us by virtue of having drafted them.
